How the competition works:
Buy a Broject Product* and get a free entry into the competition to win the Broject Car
We will be giving away the Jeep Cherokee that will be modified/upgraded based on the number of Unit sales.
Every cent spent on upgrades is done with the input of those who boughta Broject Product. At every crucial juncture of the build we will create polls for the entrants to complete. e.g. Will it be a rock crawling beast, mud crawling monster or a rad overlander. – You choose! 2, 4 or 6 inch lift? – You decide! LED bar or Spots, both? – You decide!! Snorkel, Long Range Tank? – Your call! Lockers, oh yes…. But which kind??? – You decide!!! Once everyone has voted or the voting window has closed, the upgrade will be done. This process will continue until the competition closes.
1 Broject Product = 1 Vote. 10 Broject Products = 10 Votes. The boring stuff: The Broject 2017/18 – Competition rules
The Broject (Pty) Ltd with registration number 2014/221205/07 (“promoter”, “we”, or “us”) is running a promotional competition. By purchasing branded Broject merchandise to the value of R500, you get free entry into the Broject promotional competition. You stand a chance of winning the grand prize of a 4×4 stock XJ that has been modified with the modifications voted on by you the participants to the competition.
Over the next twelve months you, the participants will decide what modifications the BROS will make to the Jeep. Don’t forget to follow the BROS on this journey to creating this awesome vehicle.
2. Definitions in this Agreement
2.1 BROS means the Broject Team.
2.2 participant or you means the person who fills out a survey and entry form on www.broject.co.za.
2.3 promoter means The Broject (Pty) Ltd or its agencies used to promote this competition.
3. Duration and who can enter
3.1 The competition will run from 1 October 2017 to 1 week before the 2018 Mystery Rally (Dates TBC) and the draw will take place at the 2018 Mystery Rally (Dates TBC). Failing that, the draw will happen no later than 30 November 2018.
3.2 The competition is conducted by the promoter and its third party contractors.
3.3 No one who is a director, employee or agent of or consultant to us or who is a spouse, life partner, close family member, business partner, or associate to a director, employee or agent of or consultant to us may take part or enter the competition.
3.4 This competition is only open to legal residents of South Africa aged 18 years or over.
3.5 You must have a valid South African delivery address and ID when claiming a prize.
3.6 Entry into this competition is regarded as acceptance of these terms and conditions.
4. How to enter
4.1 To enter you must:
· purchase our branded merchandise to the value of R500 (Unless discounted for promotional reasons);
· complete an entry form on our website or invoice .
· like and follow us on Facebook;
· vote in the modifications that the BROS will make to the vehicle;
4.2 You may only enter as many times as you like. For every R500 you spend on our merchandise you will receive an entry.
4.3 For an entry to be valid, you must fill in the entry form completely and truthfully.
4.4 We are not liable for any technical failure that may result in an entry not being successfully submitted.
4.5 Consumer Protection Act. Under the Consumer Protection Act (CPA), we need to keep records of all the people used to promote the Promotional Competition. We (or one of our subcontractors or affiliates) will keep this agreement for three years to serve as the record as required by the CPA.
5. No liability for Facebook
5.1 The competition is in no way sponsored, endorsed or administered by, or associated with, Facebook or Twitter.
5.2 You release Facebook and twitter of all liability for any damage you may suffer. You will be giving information to us and not to Facebook or Twitter.
6. Promotional competition reward
6.1 Prizes. You can win a 2001 Jeep Cherokee 4.0 LTD with modifications that may include suspension, wheels, tyres, bumpers, roof racks, cosmetic upgrades and more.
6.2 Voting. Once we have reached 100 entrants a number of upgrade options will be loaded onto The Broject website www.broject.co.za . All competition entrants will be notified via email and will be able to vote on which upgrades they would like to do at that point in time, as offered by the BROS.
6.3 Redeeming prizes. We will award prize after the close of the competition within a reasonable time.
6.4 Modifications. Modifications will be determined by the number of entries there are for the competition. We cannot guarantee what modifications will be decided upon by the participants during the competition period. Modifications are dependant on T-Shirt sales and voter input.
6.5 Transportation of prizes. You are responsible for the transportation of the prize that you have won.
6.6 Licensing. The winner will be responsible for registering the vehicle in his or her name on winning the modified vehicle. We provide the vehicle with a license that is up to date but we cannot provide you with a roadworthy certificate. This will be for your own costs.
6.7 Prize costs. All costs and expenses associated with Prize acceptance and use not specified by us, are the winner’s sole responsibility.
6.8 Limitation to using your prize. Certain conditions may apply to redeeming your prize (for example roadworthy certificates and licensing). We will not be responsible for any loss or damage caused by you not being able to use the prize at a time that is convenient for you.
6.9 Warranties. You agree that the promoter will have no liability to the fullest extent permitted by law, and will be held harmless by winner for any injuries, losses or costs or damage of any kind resulting in whole or in part, directly or indirectly from acceptance, possession, misuse or use of the Prize or parts thereof
7. Prize winner selection and publicity
7.1 Choosing a winner. The prize winners will be randomly drawn by the promoter after the end of the competition.
7.2 How will you know if you have won. The winner will be contacted telephonically, through email, or sms after they have been selected. We will attempt to contact winners three times during a 72 hour period. If we cannot contact the winner during this period we will draw another winner. Winners who have not given the promoters the correct details will forfeit the prize.
7.3 We may ask winners to take part in publicity connected to this competition. Winners grant permission for us to use their names and photographs in any advertising and promotional material for this competition. You may ask us to remove your name or refuse to take part in any publicity.
7.4 No payment. You will not receive any payment for taking part in the competition, or taking part in any media format related to it.
7.5 The prizes are not transferable. You cannot ask us to give you another prize of similar value or to pay out the value of the prize. We may substitute any prize with another prize of similar value.
7.6 Forfeiture. If you do not claim your prize within 1 Month you will forfeit it and we may re-award it.

8. Dispute resolution
8.1 Arbitration. If there is any dispute, the parties must refer the dispute within 15 business days to arbitration (including any appeal against the arbitrator’s decision) under AFSA’s latest rules for expedited arbitrations.
8.2 CPA dispute resolution. Despite 8.1, any party may use other dispute resolution channels provided for by the CPA or other law.
8.3 Severability. This clause is separate and divisible from the rest of this agreement and stays effective even if this agreement ends or is invalid.
9. General Rules
9.1 No liability. By taking part in this competition you agree that you will not hold us liable for any losses, harm, damages, injury, claims or actions related to this competition.
9.2 Force majeure. No party will be responsible for any breach of this agreement caused by circumstances beyond its control.
9.3 Changing the rules. These rules, including the duration of the competition, can only be reasonably changed (or superseded) by us in a written revision to these rules posted on the competition website or any other potential official competition communication methods we use to reach a majority of potential participants.
9.4 Tax. Income or other taxes relating to the prizes, if any, are the sole responsibility of the prize winner.
9.5 Governing laws. South African laws govern this competition.
9.6 Use of personal information. Participants understand and agree that in order to offer the competition, the promoter must collect and use personal information about them.
9.7 Termination of the competition. If we need to, because of legislative or regulatory reasons, we may terminate the competition immediately and without notice. If this happens you will not have any claim against us, because of this.
